Which Car Wreck Attorney? How to Hire a Personal Injury Attorney

October 19, 2013

No two car wreck lawyers or car wreck law firms are alike. Some operate in a way that is often described by former clients as a “mill”, where clients often speak to a high school graduate during the initial intake call, then often assigned the matter to a high school graduate to process the case, before the matter gets into the hands of a case manager who is not likely to ever be an attorney. At Marchese Injury Law, P.A., when you call to ask about a potential case, or if you become a client, you have full access to the attorney who will be helping you from beginning to resolution. An injured person must go through a difficult time: lost work, medical bills, and the aggravation of pain. An attorney can help take the stress away and insure that the injured person’s rights are protected. However, choosing the right attorney can make all the difference. With what seems like hundreds of attorneys blaring at you on TV and phone books, how do you know who is right for you? Anyone can put together a fancy add or a great website, but as a client-to-be you need to do more to identify the right attorney for you. If you have not been able to speak to a personal injury attorney on the phone when you make your initial call, you can likely anticipate that they won’t be very accessible to you after you become a client. Meet with the attorney. If, in your first meeting with the firm, you are meeting with a “private investigator”, “case manager” or other non-attorney person, this can be a red flag. Some larger firms focus only on signing up as many cases as possible, and have staff members whose only job is build the caseload. This person will not be working with you again, and will often have an incentive to tell you what it takes to get the case signed and move on to the next client. Interview the personal injury lawyer you are considering to hire. Ask if they are able and willing to take the case to trial. If not, then they have an incentive to settle the case before referring the matter to another trial firm/car accident attorney…someone you had no say in choosing. The incentive to settle could very well mean that you get less for your case than you are entitled to receive. After speaking or meeting with the potential personal injury lawyer, ask yourself if you trust them and can work with them over the next year or so. If the attorney promises a specific amount of money compensation for you, then that attorney is likely either inexperienced or not trustworthy. In summary, the attorneys you see on TV or on the back of phone books may not be the optimal choice, and in fact, may be “laW-Marts” or “Mc-Litigators” who simply sign as many cases as possible and settle them quickly, regardless of the client’s needs or interests.
